CHAPTER 13

Is Ch. 13 Bankruptcy right for you?

  • Do you have debt?

  •  Have you gotten behind on your mortgage or vehicle payment?

  • Do you have a steady source of income?

MAKE EVERY PENNY COUNT

Chapter 13 bankruptcy is also referred to as a consolidation or "wage earner's plan". It enables individuals with consistent income to develop a plan to repay all or part of their debts, in exchange for keeping their property. Chapter 13 filers propose a repayment plan to pay installments to creditors over a 3-5 year period.

Chapter 13 bankruptcy is often used by couples or individuals trying to save a home from foreclosure or their vehicles from repossession, because filing Chapter 13 triggers a court ordered "automatic stay" to prevent creditors from pursing collection efforts against you for outstanding debts.  The automatic stay empowers you upon filing, to get creditors off of your back and immediately begin to feel the freedom of a FRESH START.  This immediate benefit is applied differently and may last for varying lengths of time, based on each individual's circumstances.
